Terms and Conditions
In order to proceed, you must agree with the following terms and conditions:
The hCardŽ is a fee-based discount card offered by SchoolHeart, Inc. (SH) in support of schools and nonprofit organizations. The card provides savings and benefits offered by participating sponsors online and at merchant locations across the U.S.

1. Cardholders must be 18 years old to purchase the hCardŽ. If you are under 18 years old, you must receive consent from your parent or guardian to be eligible.

2. When purchasing the hCardŽ, you must provide accurate and complete information, including but not limited to your name and shipping address. SH will use this information to create your account and to mail your hCardŽ and other materials concerning vendors and specials to you.

3. Fee : The 1-year annual hCardŽ fee will be billed to the credit or debit card, or checking account you authorize when enrolling. If submitting payment by check, your check will be processed electronically by a third party on behalf of SH. If using a check, you authorize your personal check to be used as a source of information and payment, for the check number, your checking account number, and the number that identifies your bank. This information will be used by SH to make a one-time electronic funds transfer payment from your account . If you choose, Your hCardŽ membership will be automatically renewed, unless you cancel the membership or decline via email when you receive your renewal notice. The current retail price of the 1-year hCardŽ (Fee) is $20.00 (plus $1 shipping and handling). You agree to pay the Fee when the charge is incurred.

4. The hCardŽ is usually shipped within 14 days from time of purchase.

5. When you purchase an hCardŽ online or activate it, you'll be asked to create a password in order to view your account. At this time, you must complete any missing information on your account.

6. The hCardŽ is nontransferable and may only be used by the person whose name is printed on the hCardŽ. SH does not permit the sharing of your hCardŽ, number, password or discounts with any other person. If SH reasonably believes that any of your hCardŽ materials are being improperly used, SH reserves the right to cancel your cardholder rights immediately. If you believe someone has used any of your hCardŽ materials without your authorization, please contact admin@thehcard.com

7. SH may modify its fees at any time for any reason at its sole discretion, and without notice.

8. Expiration and Cancellation : Without the automatic payment, your hCardŽ will expire on the date printed on the front of the card, which is at least 12 months from the date of purchase.

9. Refunds : The refund policy allows hCardŽ holders to claim a refund within 10 days of purchase. Shipping and handling fees are non-refundable. In order to receive a refund, you must first return your hCardŽ and materials to SchoolHeart, 2400 East Millbrook Dr. Raleigh, NC 27604. SH is not responsible for shipping charges you will incur in connection with the return of your hCardŽ.

10. hCardŽ Directory : Cardholders can search for savings and sponsors online. When you wish to purchase goods or services online, you may be required to enter your hCardŽ number in order to receive the discount. SH makes reasonable efforts to maintain a current database of sponsors and their discounts.

11. Password : Cardholders may have to setup a password to login or access certain sections of the site. If you forget your password, upon verification that you are the rightful owner of the account, SH will email your password to the email address you provided during the order or activation process.

12. You may access your site to edit and update your account information and communication preferences. You agree to provide accurate and complete information.

13. Merchant Disputes : SH is not responsible if sponsor changes its discount due to new ownership, acquisition or any other reason. If you have a dispute with a sponsor to report, email admin@thehcard.com. SH will take commercially reasonable efforts to solve the dispute on your behalf.

14. Independent Contractors : SH, its sponsors and marketing personnel are independent contractors. SH IS NOT LIABLE FOR ANY PRODUCTS OR SERVICES PROVIDED BY OR THROUGH ANY SPONSOR OF THE DISCOUNT PROGRAM, OR FOR ANY ERROR, OMISSION OR INACCURACY IN ADVERTISING MATERIAL OR FOR ANY LIABILITY RESULTING DIRECTLY OR INDIRECTLY FROM A PRODUCT OR SERVICE PROVIDED BY ANY SPONSOR OR OTHER THIRD PARTY IN CONNECTION WITH THE DISCOUNT PROGRAM.

15. Email Policy and Communication Preferences : Cardholders have the option to receive SH email updates. SH uses these updates to provide additional savings, special offers, site upgrades, new features, events, promotions and more. You have the option to email us to opt out from receiving these emails

16. SH reserves the right to email you with information essential to your participation in our program (For example: Information on lost passwords, hCardŽ shipment information and hCardŽ expiration/renewal). You will not have the option to opt-out of emails of this nature.

17. SH reserves the right to terminate the hCardŽ program at any time without notice.

18. If you don’t agree to these terms and conditions, please don’t use this site and don’t submit orders for products or services on this site. SH may deny site access to anyone at any time for any reason.

19. You agree to not use the site to upload, post, email or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; harm minors in any way; upload, post, email or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party; upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas that are designated for such purpose; upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; interfere with or disrupt the service or servers or networks connected to the service, or disobey any requirements, procedures, policies or regulations of networks connected to the service; or intentionally or unintentionally violate any applicable local, state, or national law;

20. External Sites : This site may automatically produce search results or contain links to other sites on the Internet that are owned and operated by 3rd party vendors and other 3rd parties (The "External Sites"). SH is not responsible for the availability of, or the content located on or through any external site. SH does not endorse the content (or software) of any 3rd party site, nor do we warrant that they will not contain viruses or otherwise impact your computer. By using the site to search for or link to another site, you agree and understand that you may not make any claim against SH for any damages or losses, whatsoever, resulting from your use of the site to obtain search results or to link to another site. In addition, should you link to any 3rd party site, you will be bound by the terms and conditions that apply on that site.

21. SH reserves the right to change this site agreement at any time by revising the terms and conditions herein.

22. GOVERNING LAW: This Agreement, and the respective rights and obligations hereof, are bound by the Laws of North Carolina.
